These are our terms and conditions, which apply to everyone who uses Feedgrabbr.
If you do not agree to any of these Terms and Conditions, please discontinue your use of Feedgrabbr.
Your Acceptance of our Terms and Conditions
Feedgrabbr (the “Service”) is provided by Blueberry Software Limited (“we” or “us”) on Terms and Conditions set out below (the “Terms”). We may update these terms from time to time by uploading the amended version to the Feedgrabbr website but without notifying you directly. If you continue to use Feedgrabbr following an update to the Terms you will be deemed to have accepted the changes.
You confirm that you are at least 13 years of age and that there is no legal reason why you are prevented or restricted from using Feedgrabbr.
Access to Feedgrabbr may be illegal or restricted in certain jurisdictions outside the United Kingdom. It is your responsibility to make sure that your use of Feedgrabbr is not prohibited by law in your own jurisdiction and to comply with any local restrictions which apply.
Registration
By registering to use Feedgrabbr, you agree that you will: (i) provide true, accurate, current and complete information about yourself as part of the registration process and (ii) maintain and promptly update your information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your use of Feedgrabbr.
As part of the Feedgrabbr registration process you will be required to create a password. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to notify us immediately of any unauthorised use of your password or account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this section.
Billing and Refunds
Optional Premium Accounts are available from Feedgrabbr. By selecting a Premium Account you agree to pay Blueberry Software Limited the subscription fee indicated for that service.
The fees for your Premium Account will be billed from the date you elect, or convert to, a Premium Account and for each month or year thereafter unless and until you cancel your account. We will automatically bill your credit card either monthly or annually on the calendar day corresponding to the commencement of your Premium Account. In the event your Premium Account began on a day not contained in a given month, we will bill your credit card on the last day of such month. For example, if your Premium Account began on January 31st, and you are being billed monthly, your credit card would be billed next on February 28th. You can view the next date you will be billed by logging in to Feedgrabbr and going to the “Your Account” page.
You acknowledge that the amount billed each month or year may vary for reasons that include, differing amounts due to promotional offers, differing amounts due to changes in your account, or changes in the amount of applicable sales tax, and you authorize us to charge your credit card for such varying amounts.
All fees and charges are nonrefundable and there are no refunds or credits for partially used periods.
Cancelling your Premium Account
Users with a Premium Account may downgrade the account and prevent any future payments by logging into their account, proceeding to the Account page and selecting the Cancel Subscription option on that page. Their account will be immediately downgraded to a Free Account, and all relevant restrictions applied: only one widget will remain active while all others owned by their account are deleted and any premium features used by that widget will be removed.
Disclaimer
Feedgrabbr is provided on an “as is” and “as available” basis and to the fullest extent permitted by law, we make no warranties, express or implied, in relation to your use of Feedgrabbr including, but not limited to, security, warranties of title, fitness for a particular purpose, merchantability and non-infringement of proprietary or third party rights. We make no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software, text, graphics, and links.
We make no warranty that (i) Feedgrabbr will meet your requirements, (ii) Feedgrabbr will be uninterrupted, timely, secure, or error-free, and (iii) any errors in the software will be corrected.
Your use of any content or services obtained from Feedgrabbr is at your sole discretion and risk.
No advice or information, whether oral or written, obtained by you through or from Blueberry Software Limited shall create any warranty not expressly stated in these Terms.
Security
In no event will Blueberry Software Limited, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Blueberry Software Limited under this agreement during the twelve (12) month period prior to the cause of action. Blueberry Software Limited shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
Restrictions
You shall not, nor permit anyone else to, directly or indirectly: (i) reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or underlying algorithms of all or any part of Feedgrabbr (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable local law); (ii) modify or create derivatives of any part of Feedgrabbr; or (iii) remove or obscure any proprietary notices on Feedgrabbr. Blueberry Software Limited shall own all title, ownership rights, and intellectual property rights in and to Feedgrabbr, and any copies or portions thereof.
You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of Feedgrabbr or any Content, or in any way reproduce or circumvent the navigational structure or presentation of Feedgrabbr, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Feedgrabbr website interface. Blueberry Software Limited reserves the right to bar any such activity.
You shall not attempt to gain unauthorized access to any portion or feature of Feedgrabbr, or any other systems or networks connected to Feedgrabbr or to any Blueberry Software Limited server, by hacking, password “mining”, or any other illegitimate means.
You shall not probe, scan or test the vulnerability of Feedgrabbr or any network connected to Feedgrabbr, nor breach the security or authentication measures on Feedgrabbr or any network connected to Feedgrabbr.
You shall not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of Feedgrabbr or Blueberry Software Limited’s systems or networks, or any systems or networks connected to Feedgrabbr or Blueberry Software Limited’s systems or networks.
You shall not use any device, software or routine to interfere or attempt to interfere with the proper working of Feedgrabbr, or with any other person’s use of Feedgrabbr.
You shall not use Feedgrabbr for any purpose that is unlawful or prohibited by this Agreement.
Blueberry Software Limited reserves the right to bar any restricted activity outlined above and to disable the accounts of any users engaging in such activities.
Termination
We may terminate your access to all or any part of the Service at any time, with or without notice, effective immediately, for any reason or if we believe that you have violated or acted inconsistently with the letter or spirit of the Terms. If you wish to terminate these Terms of Use or your Feedgrabbr account the user should contact the FeedGrabbr support team. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Advertisements and Promotions
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through Feedgrabbr, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. We shall have no liability for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on Feedgrabbr.
External Links
We may provide, or third parties may provide, links to third party websites or resources. These links are provided solely as a convenience to you and not as an endorsement by us of the contents on such third-party web sites. We have no control over the content or security of such sites and resources and, you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and have no liability for any content, advertising, products, services or other materials on or available from such sites or resources or for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. If you decide to access linked third-party websites, you do so at your own risk.
Changes
Blueberry Software Limited reserves the right, at its sole discretion, to modify or replace any part of these Terms. It is your responsibility to check the Terms periodically for changes. Your continued use of or access to Feedgrabbr following the posting of any changes to these Terms constitutes acceptance of those changes. Blueberry Software Limited may also, in the future, offer new services and/or features through Feedgrabbr. Such new features and/or services shall be subject to these Terms.
